These terms and conditions ("Terms") govern your use of our website, services, and products (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

1. Use of Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You are responsible for all activities that occur under your account. You must provide accurate and complete information and promptly update your information if it changes.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.

3. Account Registration

To access certain features of our Services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account login information and for any activities or actions under your account.

4. Payment, Cancellation, and Refunds

Certain Services may require payment. You agree to pay all applicable fees for the Services you select. Sessions and programs are educational and are not medical care. See section 9.

Paid sessions, including the Care Mapping Session: session fees are non-refundable.

Purchases from our shop: physical products are non-refundable once they have been taken home. If a product arrives damaged or incorrect, contact us, and we will replace it or refund it.

Nothing in this section limits any right you have under applicable law.

We reserve the right to change our fees at any time. Changes do not affect the price of a Service you have already purchased.

5. Intellectual Property

All content, features, and functionality (including but not limited to text, graphics, logos, images, and software) are the exclusive property of Just Green Living, LLC, doing business as The ApotheKerie, and are protected by copyright, trademark, and other intellectual property laws.

Nurse Yourself With Love™ is a trademark of Just Green Living, LLC. The ApotheKerie is a brand of Just Green Living, LLC.

Our brand names, program names, product names, framework language, and written materials are the intellectual property of Just Green Living, LLC. These include, without limitation, Food Peace + Body Trust, Care Mapping, Care Prescription, Return to Her, The Care Letter, The Care Room, Botanical Body Rituals, Velvet Body Butter, Polish > Nourish > Seal > Restore, and Women in their rediscovery age. You may not reproduce, distribute, or create derivative works from any content, or use any of our names or framework language, without our express written permission.

6. User Content

You may submit content (including but not limited to comments, reviews, and feedback) to our Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content. You represent and warrant that you own or have the necessary rights to submit the content and that the content does not violate any third-party rights.

If you submit a testimonial, review, or story that we would like to publish with your name or any personal details, we will ask for your separate written permission before we publish it.

7. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

Violating any applicable laws or regulations. Infringing on the intellectual property rights of others. Engaging in fraudulent, deceptive, or misleading conduct. Interfering with or disrupting the operation of our Services. Uploading or transmitting viruses or other harmful code. Harassing, threatening, or abusing others.

8. Email and SMS Communication

Email. When you join The Care Letter, you give your express consent to receive email from us by checking a separate email consent box on the signup form. We use a double opt-in process, which means we send you a confirmation email before you are added to the list. Every email we send includes an unsubscribe link, and you can unsubscribe at any time.

Text messages. Text message updates are optional and separate from email. We send text messages only where you have separately checked the text message consent box on a form. Message frequency varies. Message and data rates may apply. You can reply HELP for assistance or reply STOP to opt out at any time.

We do not rely on a single, combined consent for email and text messages. Providing your email address or your phone number does not by itself mean you consent to receive marketing messages from us. We rely only on the separate, express consent you give on our forms.

9. Health and Wellness Disclaimer

Our Services, including our content, emails, educational resources, and the Care Letter, are provided for general educational and informational purposes only. They are not medical advice, and they are not a substitute for advice, diagnosis, or treatment from a qualified healthcare provider.

Nothing on our website, in our communications, or in our sessions and programs creates a practitioner-patient or provider relationship, or any other clinical relationship, between you and us.

We do not diagnose, treat, or cure any condition through our website content or our educational materials. Noticing what your body is communicating is not the same as diagnosing it.

You should always consult your own healthcare provider before making decisions about your health, your medication, or your care, and you should continue any care they have recommended. Do not disregard professional medical advice because of something you have read or heard through our Services.

10. Personalized Services and the Care Mapping Session

We offer a paid, nurse-led Care Mapping Session. A Care Mapping Session is 30 minutes and is currently $125. It is a session to help you map your next step in wellness. It is not medical care; it is not a consultation for the purpose of diagnosis or treatment, and it does not create a practitioner-patient or provider relationship.

We do not guarantee any particular outcome, result, or level of progress from any session or program.

Paid sessions and programs may be governed by their own separate agreement and disclaimer, which applies in addition to these Terms.

11. Disclaimers

Our Services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law, in no event shall Just Green Living, LLC, doing business as The ApotheKerie, be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our Services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been informed of the possibility of such damage.

13. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of our Services or your violation of these Terms.

If we make changes to these Terms, we will provide notice of such changes by posting the revised Terms on our website and updating the "Effective Date" at the top of the page. Your continued use of our Services after the revised Terms have become effective indicates your acceptance of the changes.

We may terminate or suspend your access to our Services at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use our Services will immediately cease.

16. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the state or federal courts located in Duval County, Florida, and you hereby consent to the personal jurisdiction and venue therein.
